This includes, but is not limited to:</span></span></span></span> <ol> <li><span><span><span><span>Requesting copies of invoices for work performed.</span></span></span></span></li> <li><span><span><span><span>Directly contacting the principals to verify the existence of principal‑contractor relationships.</span></span></span></span></li> <li><span><span>Requesting proof of payroll to ensure an employer-worker relationship exists, if the independent worker has indicated they<span><span> are hiring workers</span></span>.</span></span></li> </ol> </li> </ol> </li> <li><span><span>What if an independent worker is just beginning their business and is not yet involved in multiple contracts?</span></span> <ol> <li><span><span>At the time of application, if an independent worker indicates that they have just started their business, they will be required to provide details of their business plans that demonstrates the intent to work for more than one principal for the same type of work or industrial undertaking. and will assess the employer’s payroll for the current plus preceding three years that the business should have been registered.</span></span></li> <li><span><span>If there is evidence that an employer deliberately avoided registration, the Manager of Employer Services will review the information and will assess premiums for all years the employer should have been registered. An employer may be considered to have intentionally avoided registration where they have not responded to a registration form sent out to them, an injury claim has been submitted, or by any other means determined by Employer Services.</span></span></li> <li><span><span>Where intentional avoidance has been determined, the Manager of Employer Services will also refer the employer’s file to Internal Audit for further review. Internal Audit will determine if the employer has breached the <em>Criminal Code</em>.</span></span></li> <li><span><span>Where a work related injury has occurred and it is determined that the employer intentionally avoided registration, all information regarding this decision will be referred to the Board Members to determine, at their discretion, whether the employer should be held liable for the total cost of all injuries that occurred prior to registration.</span></span></li> <li><span><span>In addition to the required premiums, the employer will be responsible for submitting the penalties based on the premiums for each year the employer should have been registered. <li><span><span>In accordance with Section 3 of <a href="http://www.qp.gov.sk.ca/documents/English/Statutes/Statutes/W17-11.pdf" rel=" noopener" target="_blank"><em>The Workers’ Compensation Act, 2013</em></a> (the “Act”), all employers and workers in Saskatchewan will be subject to the Act, except those engaged in the farming or ranching industry and those industries excluded by <em>The Workers’ Compensation Miscellaneous Regulations</em>.</span></span></li> <li><span><span>Under Regulation 4 of <em>The</em> <em>Workers’ Compensation General Regulations, 1985</em> (the “General Regulations”), an employer in a mandatory industry is required to register with the Saskatchewan Workers' Compensation Board (WCB) within 30 calendar days of commencing or recommencing business. If registration is not received within 30 calendar days, the employer may be assessed an additional five per cent of the premium assessed. In accordance with General Regulation 5, this penalty will not be less than $5, nor greater than $500.</span></span></li> <li><span><span>Under section 124(1), WCB has authority to estimate the probable payroll and assess employers who fail to register as required.</span></span></li> <li><span><span>Under section 148(1) of the Act, where for any reason an employer who should be assessed is not assessed in any year, the employer shall be liable to pay the WCB the amount for which he/she should have been assessed.</span></span></li> <li><span><span>In accordance with Section 153(2) of the Act, in the event of a work-related injury, employers who fail to meet their reporting requirement shall be held liable for the total cost of the injury. Under Section 153(3), “if the board is satisfied that failure to make or transmit any payroll statement, return or other statement was not intentional and that the employer honestly desired to furnish an accurate statement, it may relieve the employer in whole or in part from liability”.</span></span></li> <li><span><span>Section 170 permits the WCB to issue an order for the payment of money owed under the Act and such order “may be filed with the local registrar of the Court of Queen’s Bench and, when filed, may be enforced as a judgment of that court.”</span></span></li> </ol></div> </div> </div> </div> </div> </div> </div> </div> </div> <div class="paragraph policy_page_background_wrap paragraph--type--policy-section paragraph--view-mode--default"> <div class="policy_page_background"> <h2 class="h3">POLICY</h2> <div class="field field--name-field-policy-section-content field--type-entity-reference-revisions field--label-visually_hidden"> <div class="field__label visually-hidden">Policy section content</div> <div class="field__items"> <div class="field__item"> <div class="paragraph paragraph--type--section-detail-points paragraph--view-mode--default"> <div class="layout-content"> <div class="field field--name-field-section-detail-points field--type-text-long field--label-visually_hidden"> <div class="field__label visually-hidden">Section detail</div> <div class="field__item"><ol> <li><span><span>Employers in a mandatory Saskatchewan industry are required to register with the WCB within 30 calendar days of employing workers.</span></span></li> <li><span><span>Where an employer fails to register their business as required, the WCB will limit the employer’s liability to the premiums due for the current plus preceding three years that the business should have been registered. </span></span></li> <li><span><span>Where an employer intentionally avoided registration or where a work-related injury has occurred, the employer’s liability will not be limited to the current plus previous three years and will be as follows: </span></span> <ol style="list-style: lower-alpha;"> <li><span><span>The employer will be liable to pay the premiums due for all years they should have been registered. </span></span></li> <li><span><span>The employer file will be referred to Internal Audit who will determine if the employer has breached the <em>Criminal Code</em>.</span></span></li> <li><span><span>Where a work-related injury has occurred and registration was intentionally avoided, the employer file will be referred to the Board members to determine whether the employer should be held liable for the total cost of all injuries that occurred prior to registration.</span></span></li> </ol> </li> <li><span><span>When registration is greater than 30 calendar days from the date of employing a worker, the employer will also be charged an additional 5% of the premium assessed for each year the WCB has determined the employer should have been registered. The penalty will not be less than $5, nor greater than $500 for each year of non-compliance.</span></span></li> <li><span><span>Where the employer does not provide the payroll information, WCB will estimate the employer’s assessable payroll to calculate the required premiums. The employer will be bound by that assessment until they provide the actual payroll information.</span></span></li> <li><span><span>Employers who have not registered as required are not eligible for the Experience Rating Program until the year following their registration. individual and can be present in all industries.</span></span></p> <p><span><span><strong>Employer</strong> means any person, association or body that hires one or more workers on a full-time, part-time, casual, seasonal or contract basis.</span></span></p> <p><span><span><strong>Principal</strong> means any person, association or body that hires a contractor. Principals are considered employers.</span></span></p> <p><span><span><strong>Worker </strong>is a person who has entered into a contract of or for service, written or oral, expressed or implied, and includes:</span></span></p> <ol> <li><span><span>A learner.</span></span></li> <li><span><span>A member of a municipal volunteer fire brigade.</span></span></li> <li><span><span>A director of a corporation who reports earnings on a T4.</span></span></li> <li><span><span>A contractor (including a director receiving assessable earnings reported on a T4A and T5018), and</span></span></li> <li><span><span>Any person who is considered to be a worker by the Board.</span></span></li> </ol></div> </div> </div> </div> </div> </div> </div> </div> </div> <div class="paragraph policy_page_background_wrap paragraph--type--policy-section paragraph--view-mode--default"> <div class="policy_page_background"> <h2 class="h3">BACKGROUND</h2> <div class="field field--name-field-policy-section-content field--type-entity-reference-revisions field--label-visually_hidden"> <div class="field__label visually-hidden">Policy section content</div> <div class="field__items"> <div class="field__item"> <div class="paragraph paragraph--type--section-detail-points paragraph--view-mode--default"> <div class="layout-content"> <div class="field field--name-field-section-detail-points field--type-text-long field--label-visually_hidden"> <div class="field__label visually-hidden">Section detail</div> <div class="field__item"><ol> <li><span><span><a href="http://www.qp.gov.sk.ca/documents/English/Statutes/Statutes/W17-11.pdf" rel=" noopener" target="_blank"><em>The</em> <em>Workers’ Compensation Act, 2013</em></a> (the “Act”) applies to all employers and workers engaged in any industry in Saskatchewan except those industries excluded under<em> The Workers’ Compensation Miscellaneous Regulations </em>(the “Miscellaneous Regulations”) (Section 3(1)).</span></span></li> <li><span><span>The Workers’ Compensation Board (WCB) has exclusive jurisdiction to determine whether any industry or worker is within the scope of the Act (Section 20(2)). </span></span></li> <li><span><span>An excluded industry, employer or worker may apply to the WCB to be brought within the scope of the Act (Section 3(3)).</span></span></li> <li><span><span>The worker of a contractor is considered to be the worker of the principal, unless the contractor is an employer in their own right (Section 131(2)).</span></span></li> <li><span><span>If the owner of equipment, who is not an employer or does not have their own WCB coverage, enters into a contract with a principal, they are considered a worker of the principal (Section 8(2) and 8(3)).</span></span></li> <li><span><span>Employers must annually report assessable earnings paid to workers and contractors to the WCB (the Act, Section 122, and <em>The Workers’ Compensation General Regulations, 1985 </em>(the “General Regulations”), Section 3).</span></span></li> <li><span><span>Employers who hire contractors must report the name, address, nature and amount of the contract to the WCB (General Regulations, Section 17).</span></span></li> <li><span><span>An employer cannot deduct WCB premiums from workers or contractors, except in cases where a contractor, who does not have their own WCB coverage, owns/leases and operates equipment or hires another person to operate that equipment (Act, Sections 8(4), 164).</span></span></li> <li><span lang="EN-CA" xml:lang="EN-CA" xml:lang="EN-CA"><span>A non-employing proprietor, partner, or director of a corporation not reporting assessable earnings on a T4, T4A or T5018, when not under a contract for service with a principal and has no other means of availing coverage under the Act, may apply for optional personal coverage (General Regulations, Section<em> </em>14). It is the WCB’s intent to protect persons whose living depends on their own personal work from the financial consequences of a work-related injury.</span></span><span><span> </span></span></li> </ol></div> </div> </div> </div> </div> </div> </div> </div> </div> <div class="paragraph policy_page_background_wrap paragraph--type--policy-section paragraph--view-mode--default"> <div class="policy_page_background"> <h2 class="h3">POLICY</h2> <div class="field field--name-field-policy-section-content field--type-entity-reference-revisions field--label-visually_hidden"> <div class="field__label visually-hidden">Policy section content</div> <div class="field__items"> <div class="field__item"> <div class="paragraph paragraph--type--section-detail-points paragraph--view-mode--default"> <div class="layout-content"> <div class="field field--name-field-section-detail-points field--type-text-long field--label-visually_hidden"> <div class="field__label visually-hidden">Section detail</div> <div class="field__item"><ol> <li class="Bullet1">A business may operate in a form of: <ol> <li class="Bullet2">A proprietorship, which is an individual who owns and operates a business.</li> <li class="Bullet2">A partnership, which consists of two or more individuals or businesses joined together in a common business venture.</li> <li class="Bullet2">A corporation, which is a separate legal entity with a continuous existence apart from that of their shareholders, or</li> <li class="Bullet2">Other associations or bodies, which include, but are not limited to: <ol> <li class="Bullet3">A board or commission.</li> <li class="Bullet3">A municipality.</li> <li class="Bullet3">The Province of Saskatchewan and its agencies.</li> <li class="Bullet3">A school board and the conseil scolaire.</li> <li class="Bullet3">A non-profit organization.</li> </ol> </li> </ol> </li> <li class="Bullet1">Coverage with the WCB may be: <ol> <li class="Bullet2">Mandatory.</li> <li class="Bullet2">Personal or optional, which is outlined in POL 03/2014, Coverage – Personal, or</li> <li class="Bullet2">Voluntary, which is covered in POL 21/2014, Coverage - Voluntary.</li> </ol> </li> <li class="Bullet1">The following individuals operating in a mandatory industry are not automatically covered under the Act but may elect optional personal coverage in accordance with POL 03/2014, Coverage – Personal: <ol> <li class="Bullet2">A director of a corporation who hires a worker(s) or contractor(s) and is not reporting assessable earnings on a T4, T4A, or T5018.</li> <li class="Bullet2">An owner of a sole proprietorship or partnership and/or their spouse, who hires a worker(s) or contractor(s).</li> <li class="Bullet2">An individual operating a business who: <ol> <li class="Bullet3">Is not under a contract for service to a principal,</li> <li class="Bullet3">Does not hire a worker(s) or contractor(s), and</li> <li class="Bullet3">Is not an employer, worker, or contractor.</li> </ol> </li> </ol> </li> </ol> <p class="Bullet1"><u>Employer</u></p> <ol start="4"> <li class="Bullet1">All employers operating in an industry covered under the Act must register for an account within 30 calendar days of hiring a worker(s) or contractor(s) as outlined in POL 09/2011, Failure to Register a Business.</li> <li class="Bullet1">Employers are required to report assessable earnings for workers and contractor labour annually, up to the maximum assessable earnings amount per worker per calendar year, as noted in POL 24/2010, Assessable Earnings, and POL 10/2019, Maximum Assessable Wage Rate.</li> <li class="Bullet1">When a contractor is considered a worker of the principal, they are classified at the principal’s industry rate code and the principal is required to pay premiums for the contractor based on the labour portion of the contract.</li> <li class="Bullet1">Employers cannot deduct WCB premiums from workers and contractors, except in cases where the contractor, who does not have their own WCB coverage, owns/leases and operates equipment, as outlined in POL 14/2020, Contracts Involving Equipment.</li> <li class="Bullet1">A principal is required to obtain a clearance before paying any contractor to protect them from paying the contractor’s overdue premiums. Guidelines are outlined in POL and PRO 22/2014, Employer Accounts – Clearances and Letters of Good Standing.</li> <li class="Bullet1">If an out of province employer sends workers or contractors into Saskatchewan, coverage and registration will be determined in accordance with POL 07/2002, Coverage within Saskatchewan – Out of Province Employers.</li> </ol> <p><u>Worker</u></p> <ol start="10"> <li class="Bullet1">All workers in Saskatchewan, regardless of age, are covered when working in an industry to which the Act applies.</li> <li class="Bullet1">WCB does not cover workers employed in excluded industries or occupations listed in the Act and Miscellaneous Regulations. These workers may be eligible for voluntary coverage as outlined in POL 21/2014, Coverage – Voluntary.</li> <li class="Bullet1">Volunteers are not considered workers under the scope of the Act with the exception of volunteers in mine rescue work, members of the Emergency Measures Organization, volunteer firefighters, and first responders.</li> <li class="Bullet1">All family members, except the spouse of a proprietor or a partner, are considered workers if they are paid a wage or a monetary amount.</li> </ol> <p class="Bullet1"><em>Contractor</em></p> <ol start="14"> <li class="Bullet1">A contractor or subcontractor is a business or individual hired and paid by a principal to perform work or services that are: <ol> <li class="Bullet2">Carried out at the principal’s premises or worksite, or at a location determined by the nature of the work being performed.</li> <li class="Bullet2">For the purpose of the principal’s trade or business, and</li> <li class="Bullet2">Either integral or incidental to the principal’s day-to-day operations.</li> </ol> </li> <li class="Bullet1">If a contractor in an excluded industry works for a principal in a mandatory industry, the contractor and their worker(s), if applicable, are not covered as workers of the principal.</li> <li class="Bullet1">Contractors who do not hire others are independent workers and may be eligible for their own account. information obtained and decision process used to arrive at a determination as to whether an out-of-province employer is required to register with the Board.</span></span></li> <li><span><span>As per Point 1 of the policy, a "place of business" includes but is not limited to:</span></span> <ol> <li><span><span>a permanent facility or structure</span></span></li> <li><span><span>a rented facility or structure</span></span></li> <li><span><span>oil wells</span></span></li> <li><span><span>offices on construction sites,</span></span></li> <li><span><span>private residence, when used for business.</span></span></li> </ol> </li> <li><span><span>Where it has been determined that an out-of-province employer is required to register, a Letter of Good Standing must be obtained by the principal from the Board indicating that the out-of-province employer is registered and the account is in good standing. A Clearance Letter must be obtained by the principal when the job is completed and prior to releasing final payment for services, to ensure the account is paid in full.</span></span></li> <li><span><span>Where a registered out-of-province employer defaults on premiums payable with respect to the work being carried out in a Saskatchewan industry, the principal will be personally liable to pay the premium on the labour portion of that contract. The penalties and remedies available under <a href="http://www.qp.gov.sk.ca/documents/English/Statutes/Statutes/W17-11.pdf" rel=" noopener" target="_blank"><em>The</em> <em>Workers' Compensation Act, 2013</em></a> (the "Act") and the <em>Workers' Compensation General Regulations, 1985</em> (the "General Regulations") will apply.</span></span></li> <li><span><span>Where registration is not mandatory, applicants will be advised that they will not be regarded as workers under the Saskatchewan Act and therefore, must ensure that coverage is extended by the resident jurisdiction while work is being conducted in Saskatchewan, unless:</span></span> <ol> <li><span><span>the Saskatchewan principal becomes responsible for the premiums payable to the Board, or</span></span></li> <li><span><span>the out-of-province employer elects voluntary coverage with the Saskatchewan Board.</span></span></li> </ol> </li> <li><span><span>If neither 5(a) or (b) is the case, the out-of-province employer must provide a letter to the principal from the resident jurisdiction confirming the employer is in good standing and that coverage has been extended while work is being conducted in Saskatchewan. As notification to the Board, a copy of the letter must be submitted with the principal’s payroll report to avoid further assessment in Saskatchewan. It is necessary for assessment and injury coverage purposes, to determine whether an out-of-province employer is carrying on business in a mandatory Saskatchewan industry and therefore, is required to register and pay premiums to the WCB.</span></span></li> <li><span><span>Section 26 states: “If a worker suffers an injury, the worker is entitled to compensation. Workers employed in the employer's non-Saskatchewan base of operations will not be covered if they are engaged in activities that are not part of the Saskatchewan base of operations, even when working in Saskatchewan.</li> </ol> <p class="Bullet1" style="text-indent:0in; margin-top:16px"><u>Voluntary Coverage</u></p> <ol start="4"> <li class="Bullet1" style="margin-top:16px">Where the work performed by an out-of-province employer is incidental, registration with the Board is not required and the workers of the out-of-province employer will not be considered workers under the Saskatchewan Act. Regulations”).</span></span></li> <li><span><span>Under Section 3 of the Act, “an industry, employer or worker excluded from this Act may apply to the board to be brought within the scope of this Act.” Further, when an excluded employer requests coverage, they are required to notify the workers or their union that WCB coverage has been requested. An application concerning an industry not previously approved by WCB will be reviewed by the Vice President of Prevention and Employer Services who will determine whether coverage should be granted.</span></span></li> <li><span><span>Once an application has been approved, coverage will be effective 12:01 a.m. the day following the date the application is received by the WCB. If a worker is injured prior to the effective date of the coverage, the claim will not be accepted.</span></span></li> <li><span><span>When voluntary coverage has been purchased, the employer and workers are subject to the same requirements and entitled to the same benefits as those required to have coverage under the Act.</span></span></li> <li><span><span>Once an application for voluntary coverage is approved, an employer is required to provide coverage for all of the employer’s workers in that industry.</span></span></li> <li><span><span><span>Coverage will remain in effect until the employer requests in writing that coverage be cancelled or until the WCB cancels it for a reason which includes:</span></span></span> <ol style="list-style: lower-alpha;"> <li><span><span><span>Non-payment of premiums.</span></span></span></li> <li><span><span><span>Failure to provide the required payroll information.</span></span></span></li> <li><span><span><span>Providing false or misleading information to the WCB.</span></span></span></li> <li><span><span><span>Mail is returned and an alternate address cannot be found, or</span></span></span></li> <li><span><span><span>Any other instance where the WCB determines coverage should be terminated.</span></span></span></li> </ol> </li> <li><span><span>Where an employer has operations within a mandatory and an excluded industry, the employer and workers will only have coverage while they are performing work under the industry that is mandatory, unless a voluntary application has been submitted and approved by the WCB.</span></span></li> <li><span><span>The following industries and occupations may not be found eligible for voluntary coverage due to considerations such as their high rate of injury and/or difficulty in establishing a wage base:</span></span> <ol style="list-style: lower-alpha;"> <li><span><span>Artists, entertainers, and performers.</span></span></li> <li><span><span>Circus operations.</span></span></li> <li><span><span>Sports players, including sports coaches and instructors, while participating as a player or competitor in a sporting event.</span></span></li> <li><span><span>Sports coaches and instructors employed by professional sports organizations whose intent is to derive profit from the playing of the sport rather than the providing of instruction, and</span></span></li> <li><span><span>Voluntary workers, except those in mine rescue work, members of the Emergency Measures Organization, volunteer <li><span><span>A trade union is an industry subject to <a href="http://www.qp.gov.sk.ca/documents/English/Statutes/Statutes/W17-11.pdf" rel=" noopener" target="_blank"><em>The</em> <em>Workers' Compensation Act, 2013</em></a> with its salaried employees regarded as workers.</span></span></li> <li><span><span>Members of the union who act as representatives of the trade union or the trade union movement at conventions, seminars, etc., or on public bodies or while attending meetings of public bodies, and are paid for these activities, are regarded as workers within the meaning of the Act.</span></span></li> <li><span><span>Members of the union appointed as delegates in the same activities as 2 above, for which they receive no pay, are not workers, but may be deemed to be by the Board upon application of a trade union pursuant to Section 2(1)(ii)(iv) of the Act.</span></span></li> <li><span><span>Where the delegate's usual employer is not a trade union but where the usual employer grants temporary leave of absence for union activities and continues usual salary, benefits, etc., pursuant to Section 2(4) the usual employer is considered to be the employer while the worker is temporarily engaged in union activity.</span></span></li> <li><span><span>For each delegate who is not a worker of the trade union or is a person who has not been granted leave with pay by the usual employer, a per delegate fee as determined by the Board from time to time, is to apply where the union makes application for coverage. The per delegate fee can only apply to one person, and must be paid in advance of any claim in the same manner as any employer levy.</span></span></li> <li><span><span>Coverage as delegate shall apply only to administrative functions of the union, and not activities normally thought of as being related to membership activity, such as attending membership meetings or picketing. </span></span></li> <li><span><span>Scope of Coverage - Except for salaried employees of the union or union organization when travelling to and from their residence to the place of their usual employment, individuals will be considered to be in the course of their employment from the time they leave their place of residence on official business until they return thereto, except for deviation for personal reasons, and activities related to daily living such as the taking of meals, occupancy of accommodation, etc.</span></span></li> <li><span><span>Injuries occurring while enroute to dine at an establishment in reasonable proximity to the temporary work site or temporary domicile of the individual, or due to fire, structural failure of the hotel or motel where an individual is housed will be regarded as compensable.</span></span></li> <li><span><span>Assessment Payable and Allocation of Injury Costs</span></span> <ol style="list-style: lower-alpha;"> <li><span><span>Assessment for the salaried employees of a trade union is to be calculated in the normal way, that is, upon the basis of payroll, and injury costs are to be charged to the trade union’s experience.</span></span></li> <li><span><span>Where the delegate’s usual employer is not a trade union, but where the usual employer grants temporary leave of absence for union activities and continues usual salary, benefits, etc., assessment will be expected from the usual employer, and any costs arising out of injury will be charged to the usual employer’s experience.</span></span></li> <li><span><span>For each delegate who is not a worker of the trade union or is a person who has not been granted leave with pay by their usual employer, a per delegate fee, as determined from time to time by the Board, is to apply where the union makes application for coverage. Costs occurring from any injury are to be a charge to the trade union’s experience.</span></span></li> </ol> </li> <li><span><span>Earnings Loss Wage Base</span></span> <ol style="list-style: lower-alpha;"> <li><span><span>For salaried employees of a trade union the worker’s usual average weekly earnings as determined by Section 70.</span></span></li> <li><span><span>For delegates who are employees of a trade union or other employer who have been granted leave with pay for union activities, the worker’s average weekly earnings as defined by Section 70.</span></span></li> <li><span><span>While unusual, there may be situations where the delegate is unemployed.
